1. These terms apply to agreements you, as a customer, enter into with us, RedBricksStore, through the online platform Brickowl.com and website redbricksstore.nl. Unless otherwise agreed, your own general terms and conditions are not accepted.

2. When referring to days, this means working days from Monday to Friday.

3. We reserve the right not to respond to inquiries or issues during our non-working days.

4. We will only respond to emails and messages through the Brickowl system. If you contact us through any other means, we reserve the right not to respond without any negative consequences for the buyer.
 

Article 2: Registration and Company Information (from the November of 2024)

1. RedBricksStore is registered with the Chamber of Commerce under number [KvK number]. This registration confirms the legal status of RedBricksStore as a legal entity operating under the laws and regulations of the Netherlands.

2. As part of the legal obligations, RedBricksStore provides the following company information:

3. Customers can use this information to contact RedBricksStore for inquiries, complaints, or other business purposes.

4. RedBricksStore commits to fulfilling all legal obligations arising from its registration with the Chamber of Commerce, including but not limited to compliance with tax laws, reporting requirements, and other regulations applicable to businesses in the Netherlands.

5. By operating as a registered entity, RedBricksStore underscores its commitment to transparency, integrity, and responsibility in its business practices and interactions with customers.
 

Article 3: Product Information

1. RedBricksStore strives to provide accurate and complete information about all products offered.

2. Product information includes details about the condition of the products, including any defects or shortcomings, as well as detailed descriptions of the features and specifications of the products.

3. Customers are encouraged to read the product information carefully before making a purchase and to contact RedBricksStore if they have additional questions about the products.

4. RedBricksStore is not liable for any inaccuracies or omissions in the provided product information but will take all reasonable measures to correct any errors once they are identified.
 

Article 4: Age Recommendation

1. LEGO products are generally recommended for children aged 3 and older due to small parts that may pose a choking hazard to younger children.

      1.1. As a buyer, you are responsible for checking whether the LEGO products are suitable for the age of the intended recipient. We advise referring to the age recommendations on the packaging and assessing the safety of the toys before giving them to a child.

2. RedBricksStore accepts no liability for any accidents or injuries resulting from not following the age recommendation or incorrect use of LEGO products. It is the buyer's responsibility to ensure that LEGO products are used safely and appropriately by the intended age group.

      2.1. Parents and guardians are encouraged to supervise young children while playing with LEGO to ensure they stay safe and to minimize the risk of choking from small parts.
 

Article 5: Condition of Parts and Sets

1. New Parts are parts that have not been used before.

      1.1. These parts may come directly from the factory, be from sets, or be newly purchased from other stores.

      1.1.1. The examples provided are indicative and not exhaustive.

      1.2. Although new parts come directly from the factory or are purchased new elsewhere, not every individual part is inspected upon arrival. As a result, there may be unnoticed manufacturing defects or minor imperfections.

      1.2.1. Scratches, discolorations, or other minor defects on new parts are beyond my control and are considered inherent to the manufacturing process.

      1.2.2. When parts are newly purchased, they are inspected for visible issues.

      1.2.2.1. Basic issues are considered problems that are directly visible on the parts.

      1.3. I do not guarantee perfection for each new part. Any minor defects caused by the manufacturer are not a valid reason for negative feedback.

      1.4. If a new part is significantly damaged upon arrival, please contact us within 7 days and provide photographic evidence of the damage. For new sets, you may also contact LEGO customer service for missing or damaged parts.

      1.4.1. RedBricksStore will review this and offer an appropriate solution.

      1.4.2. The solution provided by RedBricksStore is final.

2. Used Parts are parts that have been used before and may show signs of wear.

      2.1. The condition of used parts may vary, but they are classified as used if there are signs of wear, discoloration, heavy damage, or scratches visible.

      2.1.1. The mentioned issues are indicative and not exhaustive; there may be other issues.

      2.2. Used parts may still be functional, but their aesthetic condition may be less than perfect.

      2.3. Customers should be aware of the variable condition of used parts and accept this condition upon purchase.

      2.4. In cases of severe damage or functional issues with used parts, contact can be made for possible solutions depending on the specific situation.

      2.4.1. The decision made by RedBricksStore is final.

3. Sets and Minifigures

      3.1. Sealed Sets: Sets that are still in the original, unopened packaging. These sets are in factory condition and contain all original parts as specified by the manufacturer.

      3.2. Incomplete Sets: Sets that are missing parts, which is inherent to the product and the risk is accepted by the buyer.

      3.2.1. There may be parts missing that have not yet been identified.

      3.2.2. The risk of missing parts lies with the buyer, and negative reviews on this matter will not be accepted.

      3.3. Complete Sets: Sets that contain all original parts as described. These sets are complete according to the original specifications provided by the manufacturer.

      3.4. Minifigures: Minifigures that are complete and undamaged unless otherwise stated in the description. Like sets, minifigures are considered 'sealed' if new and unopened, 'incomplete' if parts are missing, and 'complete' if they contain all original parts as per the description.

      3.4.1. Minifigures may be assembled and still considered new.

      3.4.2. Extra parts with minifigures are not required to be sent.

      3.4.3. Any complaints about minifigures will only be accepted if there is significant damage, for which contact must be made within 7 days with photographic evidence.


Article 6: Color Variations

1. LEGO is known for its precise color consistency, but due to production variations and changes in materials, slight color differences may occur between batches of the same LEGO elements. This is especially true for transparent colors like "Trans-Clear" and "Trans-Light Blue," as well as colors like "Pearl Gold," "Sand Green," and "Lime."

      1.1. The listed examples are just a few of the common color variations, but there may be others.

2. These color variations are inherent to the manufacturing process and are beyond RedBricksStore's control. Therefore, we cannot guarantee that all elements in an order will be exactly the same color.

3. Customers are advised to account for potential color variations when placing orders and to discuss any concerns about color differences before making a purchase.

4. It is important to note that colors displayed on the screen may differ from the actual colors of LEGO elements, depending on factors such as screen calibration, brightness, and color settings. Additionally, images of LEGO products online or in printed materials may vary in color representation and may differ from the actual colors of the products. RedBricksStore makes every effort to provide accurate images of LEGO products, but customers should be aware of potential color variations between what is seen on the screen and what is actually received.

      4.1. Therefore, we advise customers to consider these potential differences when placing orders and to discuss any questions about color representation before making a purchase. We are always available to provide additional information or images to help customers make an informed decision.

 

Article 7: Pricing Errors

1. RedBricksStore strives for accuracy and care in listing prices for its products. However, in the event of a pricing error, RedBricksStore reserves the right to correct such errors without prior notice to customers.

      1.1. A pricing error is considered an incorrect price listing that significantly deviates from the usual price of the product. This may occur due to human error, technical problems, or other unforeseen circumstances.

      1.1.1. An example of a pricing error is when a product normally sold for €10 is mistakenly listed for €0.01.

2. In the event of a pricing error, RedBricksStore has several options for handling it:

      2.1. Cancel the order and notify the customer of the correct price before taking further action.

      2.2. Offer the customer the option to keep the order at the correct price, provided it differs from the incorrect price listed.

      2.3. Provide a reasonable alternative solution given the circumstances of the pricing error.

3. Customers acknowledge and accept that RedBricksStore is not obligated to sell the product at the incorrectly listed price. RedBricksStore reserves the right to decide how to proceed in the event of a pricing error at its discretion.

4. If a customer has already placed an order at a price later found to be incorrect, RedBricksStore reserves the right to cancel or amend the order. In such cases, RedBricksStore will notify the customer of the correct price and the available options for further action.

5. Customers are advised to check product prices before placing an order and to address any questions or concerns about prices with RedBricksStore prior to making a purchase. RedBricksStore strives for open communication and fair transactions with its customers, including correcting any errors that may occur regarding price listings.

6. By placing an order with RedBricksStore, customers agree to the terms regarding pricing errors as described in this article. Customers acknowledge that they have no right to receive a product at an incorrectly listed price and agree that RedBricksStore is not responsible for any losses or damages arising from a pricing error.

7. Customers understand that pricing errors are a rare but possible aspect of online shopping and that RedBricksStore will take reasonable measures to prevent such errors. However, in the event that a pricing error occurs, customers agree that RedBricksStore cannot be held liable for such errors and that its decisions regarding the correction of the error are final.

8. In the event of a dispute regarding pricing errors, customers agree to rely on RedBricksStore's interpretation and decisions as outlined in this article. Customers understand that RedBricksStore has the final say in determining the appropriate course of action in the event of a pricing error, and such decisions are binding on all parties.

9. Limitation of Liability: RedBricksStore hereby expressly limits its liability concerning pricing errors, regardless of the cause or extent of the damage resulting from such errors. Under no circumstances will RedBricksStore be liable for indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of revenue, reputational damage, loss of goodwill, or damage to data, equipment, or property.

      9.1. RedBricksStore is not responsible for any damages arising from customers relying on incorrectly listed prices, including the costs of ordering or canceling products at such a price, or the costs of alternative purchases to compensate for the perceived loss. Customers acknowledge and accept that pricing errors are an inherent, albeit rare, possibility in online shopping, and RedBricksStore cannot be held liable for such incidents.

      9.2. The limitation of liability outlined in this article applies regardless of whether the damage arises from breach of contract, warranty, tort (including negligence), product liability, or any other legal theory, even if RedBricksStore has been advised of the possibility of such damage. This limitation of liability is applicable to the extent permitted by the applicable law in the relevant jurisdiction.

      9.3. Customers understand and acknowledge that RedBricksStore offers its products and services based on this limitation of liability and that acceptance of these terms is essential for using RedBricksStore and placing orders.


Article 8: Total Price and Payment

1. The final price of your order, unless otherwise specified in the agreement, remains unchanged. If the price is later adjusted by us, we reserve the right not to ship the goods until the full amount is paid.

2. Payment must be made within 5 days. 

      2.1 If the payment is incomplete but RedBricksStore has been contacted, we will not immediately leave negative feedback.

      2.2 If no further action is taken by the buyer within more than 10 working days after the last contact, we reserve the right to cancel the order and provide negative feedback.


Article 9: Orders

1. An order is placed when the buyer clicks on "Place Order."

      1.1 According to the following actions:
The goods intended for purchase are stored in the "Shopping Cart." You can access and modify the cart at any time via the relevant button in the navigation bar.
After calling up the "Proceed to Checkout" page and entering the personal details, as well as the payment and shipping terms, all order details are displayed again on the order summary page.
Before you submit the order, you have the opportunity to review, change (also via the "back" function of the internet browser), or cancel the purchase. By placing the order through the relevant button, you make a binding offer to accept the offer, thereby concluding the purchase agreement.


Article 10: Pre-orders

1. Definition of Pre-orders: A pre-order is an order for a product that is not yet in stock and has a future expected delivery date. By placing a pre-order, you reserve the product at the indicated price.

2. Payment: Full payment is required at the time of the order for pre-orders. This guarantees your reservation of the product.

      2.1 Price Changes: If the final selling price of the product is higher than the price at the time of the pre-order, we reserve the right to request an additional payment. The customer will be informed in advance.

3. Expected Delivery Date: While we strive to meet the indicated delivery date, it may be subject to changes due to production or delivery delays. We will inform you of any changes in a timely manner.

4. Products will be shipped as soon as they are available. For pre-orders, regular shipping costs and conditions may apply, as described in Article 11: Shipping Costs and Article 12: Shipping.


Article 11: Shipping Costs

1. The shipping rates listed on the "Terms and Conditions" page are guidelines.

      1.1 These rates may not always reflect the total shipping costs experienced by each order.

2. Shipping costs may be changed by RedBricksStore after the order is placed; these must be paid before the order is shipped.

      3.1 RedBricksStore reserves the right to adjust the above prices. The amount stated by RedBricksStore as shipping costs is final, regardless of what is mentioned in point 3.

      3.2 The prices listed above are for the year 2024.

      3.2.1 PostNL reserves the right to change these costs at any time.

      3.2.1.1 I will use the current costs at the time of the order, which may differ from the prices listed above.

      3.3 I may calculate the costs for the new year earlier if there are price changes.

      3.3.1 This is also applicable if these costs have not yet taken effect.

      3.3.1.1 RedBricksStore may determine when these costs are adjusted.

      3.3.1.2 Buyers have no right to adjustments to receive the older price.


Article 12: Shipping

1. As a business, I am not responsible for orders from the moment they are no longer my property.

      1.1 Upon request, proof can be provided in the form of a video for international shipments and always a shipping receipt for packages.

      1.1.2 This proof does not constitute legal evidence for refund arrangements.

2. If orders do not arrive, I am not liable for refunds.

      2.1 Orders without tracking and insurance carry the risk of the purchase amount being lost.

      2.1.1 If payment is made via IBAN, I am not obligated to refund the purchase amount, and such transactions are not considered fraud.

      2.2 For insured orders, you may request a refund according to the rules and conditions of the respective postal companies.

      2.2.1 The response from the postal company to this arrangement is final, and I am not required to make changes, even in cases where insurance or tracking is available.


Article 13: Delivery Times

1. Upon receipt of payment, RedBricksStore will make an effort to process and ship the order within a reasonable timeframe. We aim to dispatch orders within 1-4 business days for envelopes and 3-7 business days for packages.

      1.1. The stated delivery times are only estimates, and RedBricksStore cannot be held liable for delays that are beyond our control. Such delays may include factors such as shipping service delays, customs checks for international shipments, or unforeseen circumstances such as extreme weather conditions. We want to assure customers that we will take all reasonable measures to minimize any delays and will keep them informed in the event of significant delays, working together to find appropriate solutions.

2. Force Majeure: In the event of force majeure, RedBricksStore cannot be held liable for delays or non-delivery of the order. 

Article 14: Inventory Management

1. RedBricksStore reserves the right not to keep the inventory on Brickowl always fully up-to-date.

      1.1. In the event that an item is out of stock after an order is placed, RedBricksStore will contact the customer to discuss possible solutions, such as canceling the item or offering a similar alternative, as outlined in Article 15.1.


Article 15: Issues

1. Missing parts from the order:

      1.1. We reserve the right to compensate for missing parts of orders according to the following solutions:

      1.1.1. Refund of the amount without consultation.

      1.1.2. Including the amount in the shipment.

      1.1.3. Adding an extra part to the order to compensate for the missing parts.

      1.1.4. Issuing a coupon equal to the value of the missing parts.

      1.1.5. For small missing parts (less than €0.10), we reserve the right not to offer compensation. For missing parts valued between €0.10 and €0.40, a coupon may be issued as compensation. For missing parts valued above €0.40, the missing amount will be added to your order or refunded.

      1.2. We cannot accept negative feedback related to the actions taken by you as a buyer as described in Article 15, point 1.

2. For further issues, you should contact us before leaving negative public feedback.

3. We reserve the right to assess other issues on a case-by-case basis, and the outcome of our findings is final and cannot be altered by you as a buyer.

4. In the event that you receive an incorrect order, we offer the following options:

      4.1. You must return the incorrect order to us and will be reimbursed for the incurred costs.

      4.1.1. The incurred costs include shipping and packaging costs.

      4.1.2. The incurred costs will never exceed 20% over the standard shipping costs.

      4.1.3. We reserve the right not to acknowledge the incurred costs; in this case, the current shipping rates will be reimbursed.

      4.1.4. If we indicate that the order should be sent to an external party, the same rules apply as in Article 15, Points 4.1.2 and 4.1.3.

      4.1.5. You must provide photographic evidence showing the address of the external party clearly.

      4.2. You may keep the incorrectly sent order at no additional cost, and your order will be reimbursed.

      4.3. If you leave negative feedback as a result of an incorrect order, we reserve the right to remove this feedback.

      4.3.1. A resolution is considered complete when Point 4.1 or 4.2 has been carried out, including the associated compensation.


Article 16: Return Policy

1. Return Policy: Customers have the right to cancel the agreement within 14 days after receiving the order without giving any reason.

2. Return Procedure: To request a return, the customer must send an email to redbricksstore@gmail.com stating the order number. RedBricksStore will provide the customer with further instructions for returning the products within 2 working days.

3. Costs and Risks of Return Shipping: The costs for the return shipping are entirely borne by the customer. The risk of damage or loss during transport of the return shipment lies with the customer.

4. Refund: After receiving and checking the returned products, RedBricksStore will refund the amount of the returned products within 14 days. The refund only includes the purchase price of the returned products; the shipping costs paid by RedBricksStore will not be refunded.

5. Return Policy: Only products that are in the same condition as they were delivered, including original packaging and accessories, can be returned. Products that are damaged or show signs of use are not eligible for a refund.


Article 17: Cancellations

1. Cancellation possible: After an order has been placed and confirmed, the customer can submit a cancellation request. Each cancellation will be assessed based on the reason for cancellation and the status of the order. If the product has already been shipped, the order can no longer be canceled and the customer will be referred to the return policy in Article 16. This policy applies to both regular orders and pre-orders, as described in Article 10: Pre-orders.

2. Customer Responsibility: It is the customer's responsibility to carefully check all details of the order before confirmation. We cannot be held liable for mistakes made during the ordering process by the customer.

3. Feedback and Complaints: We strive to provide high-quality service. However, submitting negative feedback or complaints in public forums regarding the lack of a cancellation policy may be considered a breach of our terms. Customers are encouraged to resolve any issues directly with us via the contact information provided in Article 15: Issues.


Article 18: Intellectual Property

1. RedBricksStore acknowledges and respects all intellectual property rights related to LEGO brands, logos, designs, and other related properties owned by the LEGO Group or other rights holders.

2. Customers acknowledge that all LEGO-related trademarks, copyrights, and other intellectual property rights displayed on RedBricksStore are owned by their respective owners.

3. The use of LEGO trademarks, logos, designs, and other intellectual property on RedBricksStore is solely for identifying and describing the products offered and does not imply ownership rights for customers or third parties.

4. Customers are not permitted to copy, reproduce, distribute, modify, translate, reverse-engineer, disassemble, or otherwise use any LEGO-related intellectual property without prior written consent from the rightful owner.

5 .Customers are also reminded of their responsibilities regarding the respect of others' intellectual property when creating and sharing content related to purchased LEGO products. This includes not copying or distributing instruction manuals, digital designs, or other intellectual property without the explicit permission of the authors or rightful owners. It is important for customers to be aware of legal requirements and ethical standards related to the use of intellectual property and to comply with all applicable laws and regulations when sharing content related to LEGO products. Customers are encouraged to be creative and share their love for LEGO in a way that respects others' intellectual property and supports the LEGO community positively.

      5.1. Customers understand that infringing LEGO-related intellectual property rights may lead to legal action, including filing lawsuits for damages and/or seeking injunctions.


Article 19: Limitation of Liability

1. Disclaimer of Warranty: We offer our products and services "as is" and without any form of warranty unless explicitly stated otherwise. We do not guarantee that the products are free from defects, fit for a particular purpose, or meet your expectations.

2. Limited Liability: Our liability is limited to the amount paid for the product in question. Under no circumstances shall we be liable for indirect, incidental, or consequential damages, including but not limited to loss of profit, loss of data, or damage to property arising from the use or inability to use the products.

3. Force Majeure: In cases of force majeure, as described in Article 20: Force Majeure, we are not liable for delays or failures in fulfilling our obligations.

4. Liability for Pre-orders: Since pre-orders are reservations for future products, we accept no liability for any delays in delivery, changes in specifications, or cancellations by the manufacturer. In the unlikely event that a pre-order cannot be fulfilled, the amount paid will be fully refunded, which constitutes our sole and exclusive liability.


Article 20: Force Majeure

1. RedBricksStore is not liable for any delay, failure, or deficiency in the performance of its obligations under these terms and conditions if such delay, failure, or deficiency results from force majeure.

      1.1. Force majeure is defined as any event or circumstance beyond RedBricksStore's reasonable control, including but not limited to natural disasters, war, terrorism, strikes, civil unrest, fire, floods, government actions, or any other event or circumstance that could not reasonably have been anticipated or prevented.

      1.2. In the event of force majeure, RedBricksStore will make all reasonable efforts to minimize the impact of such event or circumstance and continue its obligations under these terms and conditions once the force majeure situation is resolved.


Article 21: Changes to the Terms

1. RedBricksStore reserves the right to modify or amend these terms and conditions at any time at its sole discretion. Such changes will take effect as soon as they are published on the RedBricksStore website.

      1.1. Customers are advised to regularly review the terms and conditions for any changes. Continued use of RedBricksStore after changes have been made implies acceptance of the revised terms and conditions.


Article 22: Waiver

1. RedBricksStore's failure to enforce any provision of these terms and conditions does not constitute a waiver of its right to enforce such provision at a later time.

2. The failure to enforce a provision in these terms and conditions does not imply approval of the breach of that provision, nor does it affect the validity of the remaining provisions of these terms.


Article 23: Privacy Policy

1. Collection and Use of Personal Data

      1.1. RedBricksStore collects personal data provided by customers when placing an order. 

      1.2. Personal data may include, but is not limited to: name, address, email address, telephone number, payment information and preferences of the customer. 

      1.3. This data is used for processing orders, communicating with customers, and providing information about products and services. 

      1.4. RedBricksStore acts in accordance with the General Data Protection Regulation (GDPR) and collects, uses and stores personal data only for the purposes for which it was provided.

2. Rights of Customers:

      2.1. Customers have the right to access, correct, delete or object to the processing of their personal data. 

      2.2. Requests regarding these rights can be submitted by contacting redbricksstore@gmail.com.

      2.3. Customers also have the right to file a complaint with the Dutch Data Protection Authority if they believe that their data is being processed unlawfully.

3. Sharing Data with Third Parties:

      3.1. Personal data may be shared with third parties that are necessary for the performance of our services, such as payment providers and delivery services.

4. Security of Data:

      4.1. RedBricksStore takes appropriate technical and organizational measures to protect the personal data of customers against loss, theft, or unauthorized access.

Article 24: Applicable Law and Jurisdiction

1. These terms and conditions and all agreements between RedBricksStore and customers are governed by Dutch law.

2. Any disputes arising from or related to these terms and conditions or the agreements between RedBricksStore and customers shall be submitted to the District Court of The Hague in the Netherlands.

 

Article 25: Interpretation of the Terms

1. In case of any conflict, ambiguity, or interpretation dispute regarding these terms and conditions, RedBricksStore's interpretation shall be deemed final and binding.

2. Customers acknowledge and agree that any interpretations or decisions made by RedBricksStore regarding the terms and conditions are final and not subject to appeal or dispute, unless explicitly stated otherwise in these terms.


Article 26: Entire Agreement

1. These terms and conditions constitute the entire agreement between RedBricksStore and customers regarding the subject matter and replace all prior or contemporaneous agreements and arrangements, both oral and written, related to the same matter.

2. Customers understand and acknowledge that RedBricksStore offers its products and services based on this limitation of liability and that acceptance of these terms is essential for using RedBricksStore and placing orders.

 

Article 27: Confirmation and Consent

1. By clicking the "Order" button or making a payment via external platforms outside of Brickowl, the customer expressly agrees to these terms and conditions of RedBricksStore.

2. This agreement constitutes confirmation of the acceptance of the terms and conditions and the resulting obligations, including but not limited to payment obligations and delivery terms.

3. This article forms an integral part of the terms and conditions, as described in Articles 1 through 26.
